Terms of Service

The agreement between you and us: what you get when you rent or buy, how payment and refunds work, and what is not allowed.

1. Who you are dealing with

ViewPoint—EA is operated by LAJ House Limited, a company registered in Kenya. Where these terms say “we” or “us”, they mean LAJ House Limited.

2. You must be 18 or over

You need to be at least 18 to hold an account. If we learn an account belongs to someone under 18 we will close it and refund anything unwatched.

3. Your account

You are responsible for what happens under your account: keep your password to yourself, and tell us promptly if you think someone else has got into it. The details you give us at signup should be accurate, and you should keep them current. One account is for one person.

4. Renting a film

A rental gives you 48 hours of access, counted from the moment your payment completes — not from when you first press play. If you pay on Monday and do not watch until Wednesday, the window has already closed. Start watching soon after you rent.

We would rather be plain about that than let you find out afterwards. A first-play clock is fairer and we intend to move to one; until we have built it, this is what the platform actually does and so it is what these terms say.

5. Buying a film

Buying gives you streaming access for as long as ViewPoint—EA operates, including if the creator later withdraws the film from sale. A creator can stop selling a film at any time; that removes it from the catalogue but does not take it away from people who already bought it. It stays in My Library and it keeps playing.

Two limits we would rather state than bury. This is access to a stream, not a file you own — there is no download, and it is not transferable. And “for as long as the platform operates” is exactly that: if ViewPoint—EA shuts down, the streaming stops. We will give reasonable notice if that ever becomes likely.

If a film has to come down for a legal reason — a copyright claim, a court order — we may be unable to keep serving it. If that happens and you bought it, tell us and we will refund you.

6. Paying

Payments are taken in Kenyan shillings by M-Pesa through IntaSend, our payment processor. You enter your payment details with them; we never see or store your M-Pesa PIN. We keep the record of the transaction — which film, which type, how much, when, and IntaSend’s reference — because that record is what proves you own what you bought.

7. Refunds

You get a full refund when the fault is ours. That includes a payment that went through but did not unlock anything, a duplicate charge, the wrong film unlocking, or a film that will not play because something on our side is broken. Write to viewpoint@lajhouseltd.com and we will refund you.

There is no refund once playback has started, or once a rental window has lapsed. Watching a film and not enjoying it is not a refund. Because the rental clock starts at payment (clause 4), a window can lapse before you ever press play — if that happens to you and you have not watched any of it, write to us and we will look at it.

8. What you may not do

  • Record, screen-capture, download, re-upload or redistribute any film.
  • Get around, or try to get around, the measures that protect films.
  • Share your account so other people watch on your purchases.
  • Scrape the site, or hit it with automated traffic.
  • Upload anything you do not hold the rights to — creators, see the Creator Agreement.
  • Use the platform to defraud anyone, including us.

9. Ending things

You can close your account whenever you like. Closing it ends your access, including to films you bought — so if there is something you still want to watch, watch it first.

We can suspend or close an account that breaks these terms. Where money is involved we will not use suspension as a way of avoiding what is genuinely owed, though we may hold a payout while we look into a specific claim.

10. What we cannot promise

We will work to keep ViewPoint—EA running and the films playing, but we do not guarantee the service will be uninterrupted or free of faults. To the fullest extent Kenyan law allows, we are not liable for indirect or consequential loss, and our total liability to you for any claim is limited to what you have paid us in the twelve months before it arose.

Nothing here excludes liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, or for fraud. Nothing here removes the rights you have as a consumer under Kenyan law.

11. Changes

We will update these terms as the platform changes and when counsel has reviewed them. Every version carries a number and a date. If a change materially affects your rights we will ask you to accept the new version the next time you sign in, rather than quietly editing the page.

12. Governing law

These terms are governed by the laws of Kenya, and the courts of Nairobi have exclusive jurisdiction over any dispute arising from them.
